(Jefferson City) – The Adam Smith Foundation today applauded Governor Matt Blunt for appointing Clay County Circuit Judge James E. Welsh to the Western District Court of Appeals. Blunt chose Welsh from the panel of three candidates submitted to him by the Appellate Judicial Commission. The Adam Smith Foundation has been an outspoken critic of the secretive process used by the Appellate Judicial Commission to select judicial nominees, arguing that the process allows the Commission to nominate partisan activists rather than the most qualified candidates.
According to Adam Smith President John Elliott, the appointment of Judge Welsh, a highly regarded jurist with a record of judicial restraint, is evidence that the Commission is listening to its critics and is responding by giving Governor Blunt better nominees.
“Judge Welsh is a model for our judiciary and we sincerely congratulate him on his appointment,” said Elliott. “Unlike too many of the nominees the Appellate Judicial Commission has chosen in the past, Judge Welsh is the kind of judge who will refuse to legislate from the bench or impose his personal preferences on Missourians. Most importantly, he understands the importance of judicial humility and promises to defend the common sense values Missourians have expressed in their Constitution.”
